  • The Terms of Service of Yuyu Japan (hereinafter “the Terms of Service”) as specified below provide for the matters that registered users shall comply with and the rights and obligations of registered users and Quantium Solutions (Japan) Inc. (hereinafter “Quantium”) upon the use of the international shipping and overseas forwarding service that Quantium provides. Those who wish to be registered users of the service should read through these terms of use before agreeing to the terms of use.

  • Article 1 Scope of Application

    • 1. The Terms of Service specify the rights and obligations of each registered user (as defined in Article 2) and Quantium for the use of the service (as defined in Article 2) and bind each registered user and Quantium upon the use of the service.
    • 2. The rules and provisions of the service posted on Quantium’s website (as defined in Article 2) shall constitute a part of this agreement.

    Article 2 Definitions

    • Terms used herein shall be defined as follows:
    • (1) The term “Intellectual property rights” refers to copyrights, patent rights, utility model rights, trademark rights, design rights, and other intellectual property rights (including the rights of acquiring Intellectual property rights and/or applying for the registration of Intellectual property rights.)
    • (2) The term "Quantium’s website" refers to the website under the domain of https://www.2you4.jp managed by Quantium (including revised websites if the domain or content of Quantium’s website is changed, regardless of the reason for the change).
    • (3) The term “registration applicant” refers to a person willing to use the Service, as defined in Article 3.
    • (4) The term “registration information” refers to certain information that Quantium specifies, as defined in Article 3.
    • (5) The term “registered user” refers to an individual or corporate body registered as a user of the service in accordance with Article 3.
    • (6) The term “Service” refers to a procedure acting service named Yuyu Japan that Quantium provides in order to undertake forwarding work using the international postal service of Japan Post (including revised service if the name or content of the international postal service is changed , regardless of the reason for the change).
    • (7) The term “goods” refers to commercial products that each registered user specifies as a target of the service to be shipped to Quantium.
    • (8) The term “User Agreement” refers to a contract between a registered user and Quantium based on the Terms of Service, which shall come into effect in accordance with Paragraph 4, Article 3.
    • (9) The term “Japan Post” refers to Japan Post Co., Ltd. (Headquartered in 1-3-2 Kasumigaseki, Chiyoda-ku, Tokyo) (including revised corporate names and headquarter locations if the present name and address are changed).

    Article 3 Registration

    • 1. A person willing to use the Service (hereinafter “registration applicant”) may file an application with Quantium to make registration to the Service on the condition that the registration applicant agrees to comply with the Terms of Service and provides Quantium with certain information that Quantium specifies (hereinafter “registration information).
    • 2. An individual or corporate body willing to use the Service shall make an application for registration, and no application for registration by proxy is acceptable, in principle. A registration applicant shall furnish Quantium with true, correct, and up-to-date information on the registration applicant at the time of filing an application.
    • 3. Quantium determines the acceptance of each registration applicant according to Quantium’s criteria and notifies the registration applicant to that effect in the event that Quantium accepts the applicant, and the applicant’s registration is deemed to be completed by this notification.
    • 4. Upon completion of the registration set forth in the preceding paragraph, a User Agreement shall be deemed to be established between the registered user and Quantium, and the registered user may use the Service in a manner that Quantium specifies.
    • 5. Quantium may not accept any registration applicant applying for registration based on the first paragraph if the registration applicant falls under any of the items below.
      • (1) Quantium has determined that there is a risk that the registration applicant may violate the Terms of Service.
      • (2) A false statement, clerical error, or omission has been found in any part of the registration applicant’s registration information provided to Quantium.
      • (3) The registration applicant was a registered user whose registration was revoked in the past.
      • (4) The registration applicant is a person under age, adult ward, warrantee, or person under assistance, and the registration applicant’s application is not with the consent of his/her legal representative, guardian, curator, or assistant.
      • (5) The registration applicant is a member of antisocial forces (e.g., a crime syndicate member, gangster, right-wing group member, or a member of other antisocial or equivalent forces), or Quantium determines that the registration applicant has a relationship with antisocial forces or is involved with the activities of antisocial forces, including any cooperation or involvement with the maintenance, management, or operation of antisocial forces through funding and other means.
      • (6) Quantium has determined that the registration applicant is inappropriate.

    Article 4 Change of Registration Information

    • A registered user shall inform Quantium of any change in the registered user’s registration information without undue delay in a method that Quantium specifies, and submit data that Quantium requests.

    Article 5 Password and User ID Management

    • 1. A registered user under the registered user’s own responsibility shall manage and retain the registered user’s password and user ID, and shall not let third parties use them and shall not rend, transfer, sell, purchase them back or make an ownership change in them.
    • 2. A registered user shall be responsible for loss or damage caused by the inadequate management of the registered user’s password or user ID, malpractice in the use of them, or third parties’ use of them, for which Quantium shall not take responsibility.
    • 3. If a registered user finds that the registered user’s password or user ID has been stolen or used by any third parties, the registered user shall immediately inform Quantium of that effect and follow Quantium’s instructions.

    Article 6 Charges and Payment

    • 1. A registered user shall bear the following usage charges for the user of the Service. The breakdown of usage fees shall conform to a price list that Quantium shall specify separately.
      • (1) Storage charge
        • (a)The storage charge shall be based on the actual occupancy space of the goods on a daily basis based on the volume of the goods calculated from the dimensions of the goods.
      • (2) Shipping service charge
        • (a)The shipping service charge covers warehousing, returning, inspection, picking, and packing, packing material, inventory, and shipping documentation of the goods, and claimed per sales package.
        • (b)The goods shall be classified into a standard or large size according to the size of the goods.
      • (3) Forwarding charge
        • (a)The forwarding charge, including the freight to the destination specified by the registered user, shall be claimed per shipment package.
      • (4) Special costs
        • The registered user shall bear customs duties or tax imposed on the goods at the transit point or destination of the goods, freight other than that for the registered user’s designated destination from Quantium, and charges other than the said freight (hereinafter “special costs”), if any. Quantium shall not be obliged to make temporal payment on the registered user's behalf.
      • (5) Quantium may make individual charge settings according to the prospective quantity, characteristics, and size of the goods, in which case the contents of the goods shall be confirmed in writing use on a case-by-case basis.
    • 2. The weight of goods as a basis of usage charges shall be based on the result of Quantium’s weighing.
    • 3. The registered user shall remit the usage charges in accordance with payment conditions specified below to the following bank account designated by Quantium, or otherwise the registered user shall settle the usage charges through PayPal. The registered user shall bear transfer fees and other expenses, if any, incurred.
      • (1) Storage charge
        • (a)Quantium shall claim the storage charge as well as the shipping service charge (2) and forwarding charge (3) when the shipment of the goods is determined, and Quantium shall forward the goods after Quantium confirms the receipt of the payment.
      • (2) Shipping service charge
        • (a)Quantium shall claim the shipping service charge as well as the storage charge (1) and forwarding charge (3) when the shipment of the goods is determined, and Quantium shall forward the goods after Quantium confirms the receipt of the payment.
      • (3) Forwarding charge
        • (a)Quantium shall claim the forwarding charge as well as the storage charge (1) and shipping service charge (3) when the shipment of the goods is determined, and Quantium shall forward the goods after Quantium confirms the receipt of the payment.
      • (4) Special costs
        • (a)Quantium shall claim the special costs as well as the storage charge (1) and the shipping service charge (2) when the shipment of the goods is determined, and Quantium shall forward the goods after Quantium confirms the receipt of the payment.

    • 4. If a registered user has delayed the payment of usage fees, the registration user shall pay Quantium a late payment charge at the rate of 14.6% per annum.

    Article 7 Use of the Service

    • 1. A registered user may use the Service in a method that Quantium specifies during the validity period of the User Agreement within the scope of the purposes of the Terms of Service and without breaching the Terms of Service.
    • 2. A registered user shall authorize Quantium to conclude a contract in the name of the registered user with Japan Post for international postal service.
    • 3. A registered user shall agree that the Service shall be performed in accordance with the International Postal Agreement (http://www.post.japanpost.jp/about/yakkan/3-1.pdf) and the Table of International Postal Conditions (http://www.post.japanpost.jp/cgi-kokusai/) of Japan Post (including revised websites if the domain or content of the website is changed, regardless of the reason for the change) and accept the said agreement and conditions.
    • 4. Quantium specifies type, size, weight, forwarding address, and other restrictions on goods. A registered user shall not be allowed to use the Service beyond the restrictions that Quantium specifies.
    • 5. A registered user shall be responsible for the preparation, maintenance, and costs of a computer, software, peripheral devices, the Internet line, and other communications environments necessary to receive the Service.
    • 6. A registered user shall be responsible to take security measures at the registered user’s own expense, including the protection of the registered user’s computer from viruses, unauthorized access, and information leakage, according to the registered user’s usage environment of the Service.
    • 7. A registered user who has purchased goods to be a target of the Service shall immediately give an accurate notice of information (hereinafter “the Notice”) necessary for Quantium’s provision of the Service, including the shipment of the goods, in a format specified by Quantium.

    Article 8 Inspection of Goods

    • 1. Quantium may open goods to conduct a content inspection (hereinafter “inspection of goods”) in order to check the appropriateness of international postal service for the provision of the Service. In that case, Quantium may open and replace the packing with different packing that Quantium specifies, and the registered user shall agree to the unpacking of the goods without being restored to the original state. Quantium, however, shall not be obliged to conduct the inspection of goods.
    • 2. If Quantium finds that the goods contain any commodities falling under any of the items in Paragraph 1, Article 9, commodities not acceptable by international postal service, or other commodities that Quantium determines inappropriate, Quantium may contact the police and relevant government offices and take measures deemed necessary, such as the submission, disposal, or discarding of the goods. In that case, Quantium may not provide the Service to the registered user who has shipped the goods.
    • 3. Quantium shall not guarantee the legality of the goods that underwent the inspection of goods (the compliance of the goods with domestic or international laws and regulations at the place of dispatch, transit point, and place of destination), authenticity of the goods, absence of any infringement on the terms and conditions of Japan Post, and absence of quality problems, defects, or other problems.
    • 4. Quantium shall not be responsible for any loss or damage caused to registered users as a result of the inspection of goods or measures taken in accordance with the Terms of Service.

    Article 9 Prohibited Goods

    • 1. A registered user shall not handle any of the following items as goods for the use of the Service.
      • (1) Cash, checks, bills, share certificates, and other securities (including gift certificates, air tickets, event tickets, and other cash vouchers)
      • (2) Savings/deposit books, cash cards, and withdrawal cards issued by banks and other financial institutions
      • (3) Credit cards and similar cards
      • (4) Documents that include messages (except for recording documents) addressed to specific persons and exchanged between persons other than the senders and receivers (including those who live together with the senders or receivers)
      • (5) Living animals and plants, animal carcasses, and animals stuffed by taxidermists
      • (6) Human bodies, human body parts, dead bodies, human remains or mortuary tablets
      • (7) Food, drink, or other items susceptible to deterioration in quality or decomposition
      • (8) Stimulants, cannabis, narcotics, psychotropic substances, or other illegal drugs banned in the destination country
      • (9) Guns, swords, or weapons, and war machines
      • (10) Pharmaceuticals and medical equipment
      • (11) Child pornography, adult videos, and other immoral or obscene articles
      • (12) Pirated or counterfeit items
      • (13) Items acquired in illegal methods or by illegal means
      • (14) Items that may exert harm to the public or handlers or that may contaminate or damage other postal matters, postal facilities, or third parties’ properties
      • (15) Explosives, gunpowder, poison, deleterious substances, explosive or ignitable substance, radioactive materials, and hazardous materials
      • (16) Items with unknown destinations
      • (17) Items not acceptable in accordance with Japan Post’s terms and conditions
      • (18) Postal items prohibited in countries of transit or the destination countries or other items the movement or distribution of which are prohibited by the laws and regulations of Japan, countries of transit, and the destination countries
      • (19) All other items deemed inappropriate by Quantium
    • 2. A registered user shall not conduct any of the following acts for the use of the Service.
      • (1) Acts of infringing on the intellectual property rights, portrait rights, privacy rights, honor, and other rights or interests of Quantium, other registered users, Japan Post, or third parties (including acts that directly or indirectly cause the foregoing)
      • (2) Acts related to criminal acts or act contrary to public order and morality
      • (3) Acts of sending obscene information or acts of sending harmful information to youth
      • (4) Acts of sending information about dating
      • (5) Acts violating laws and regulations or the internal rules of Quantium or an organization to which the registered user belongs
      • (6) Act of sending computer viruses or information including harmful computer programs
      • (7) Acts of tampering information that may be available to the Service
      • (8) Acts of using the Service to send data with a capacity in excess of a certain limit that Quantium specifies
      • (9) Acts that may interfere with Quantium’s operation of the Service
      • (10) All other acts deemed inappropriate by Quantium
    • 3. If Quantium determines that information sent by registered users through the Service falls or may fall under any of the items specified in the preceding paragraph, Quantium may delete all or part of the information without informing the registered users in advance. Quantium shall not be responsible for any loss or damage caused to the registered user by measures that Quantium takes in accordance with this paragraph.

    Article 10 Suspension of the Service

    • 1. Quantium may suspend the provision of the Service to a registered user even after Quantium accepts goods from the registered user if Quantium determines that the registered user or the goods of the registered user should fall under any of the following conditions.
      • (1) The goods fall under any of the items of Paragraph 1, Article 9.
      • (2) The address of the registered user or the destination address of the goods is not confirmed.
      • (3) The Notice is missing.
      • (4) The goods informed in the Notice vary from the goods that Quantium receives or the contents of the Notice is incorrect.
      • (5) The registered user fails to pay the charges for the Service.
      • (6) The registered user is in breach of the Terms of Service.
      • (7) The product has been purchased by means of payment that Quantium cannot receive, such as cash on delivery.
      • (8) The carriers of the goods do not transport the goods.
      • (9) The goods are seized by customs.
      • (10) The recipient refuses to take delivery of the goods.
      • (11) The provision of the Service is deemed inappropriate by Quantium for any other reason.
    • 2. Quantium shall not be responsible for any loss or damage caused to the registered user by measures that Quantium takes in accordance with this article.

    Article 11 Disposal of Undeliverable Goods

    • 1. If a registered user or the goods received from the registered user should fall under any of the conditions stipulated in the first paragraph of the preceding article (with the exception of (1)), Quantium shall retain the goods for a period of 60 days from the date of receipt.
    • 2. In the event that all of the grounds stipulated in the first paragraph of the preceding article are resolved before the end of the specified period, the registered user may instruct Quantium to ship the goods to their address or process the goods in a manner the Quantium approves.
    • 3. In the event that all of the grounds stipulated in the first paragraph of the preceding article are not resolved before the end of the specified period, Quantium may sell the goods or dispose of the goods by other appropriate means (including, but not limited to, the disposal of the goods in accordance with the Civil Execution Act).
    • 4. If Quantium sells the goods, as detailed in the preceding paragraph, Quantium may use the proceeds to cover the cost of retaining and disposing of the goods, usage charges of the Service, and other expenses.
    • 5. If there is any outstanding amount after the disposal of the goods in accordance with the preceding paragraph, Quantium shall transfer the outstanding amount to an account designated by the registered user within 20 days of the date on which the amount is finalized or the date on which the registered user designates an account, whichever is later. The registered user shall bear transfer charges and other necessary expenses, if any.
    • 6. The outstanding amount detailed in the preceding paragraph shall remain interest free.
    • 7. Quantium shall accept no liability whatsoever for damage the registered member sustains as a result of the disposal of the goods as outlined in this article.

    Article 12 Stoppage or Interruption of the Service

    • 1. Quantium may stop or interrupt all or part of the Service without any prior notice to registered users under any of the following events.
      • (1) Regular or emergency inspection or maintenance work is conducted on the computer system used for the Service.
      • (2) The operation of computers and communication lines came to a stop due to accidents.
      • (3) The operation of the Service is disrupted due to force majeure, such as a fire, power failure, and natural disaster.
      • (4) Japan Post has encountered trouble, stopped or interrupted providing its service, stopped its cooperation to the Service, or made specification changes.
      • (5) Quantium has determined that the necessity for the stoppage or interruption of the Service for any other reason.
    • 2. Quantium may terminate the provision of the Service on account of Quantium’s own reason. In this case, Quantium will inform registered users in advance.
    • 3. Quantium shall not be responsible for any loss or damage caused to registered users as a result of measures taken in accordance with this article.

    Article 13 Storage of Information

    • Quantium shall not be responsible for storing messages and other information exchanged with registered users even though the messages and information are saved for a certain operational period, and may delete such messages and information at any time. Quantium shall not be responsible for any loss or damage caused to registered users as a result of measures taken in accordance with this article.

    Article 14 Precautions for Downloading

    • A registered user may download or use other means to obtain software or other applications available on Quantium’s website and install the software or applications on the registered user’s computer. In that case, the registered user pays sufficient attention so that the registered user’s information will not be lost or altered or equipment will not have failures or receive loss or damage. Quantium shall not be responsible for loss or damage caused to the registered user.

    Article 15 Vested Rights

    • 1. All property rights and intellectual property rights related to Quantium’s website and the Service belong to Quantium or those who have licensed their rights to Quantium. Permission for the use of the Service based on user registration set forth in the Terms of Service shall not mean that registered users are authorized to use the property rights or intellectual property rights of Quantium or those who have licensed their rights to Quantium related to Quantium’s website and the Service. Registered users shall not conduct any deeds (including, but not limited to, disassembling, decompiling, and reverse engineering) that may cause infringement on the property rights and intellectual property rights of Quantium or those who have licensed their rights to Quantium.
    • 2. Quantium may make use of text, image, video, and other data (including the replication, copying, modification, third parties’ use, and any other use of such data), which registered users post or transmit to Quantium’s website or Service, for free without any restrictions.

    Article 16 Cancellation of Registration

    • 1. If a registered user falls under any of the following conditions, Quantium may temporarily suspend the Service for the registered user or cancel the registered user’s registration with no prior notice.
      • (1) The registered user has failed to comply with any of the articles of the Terms of Service.
      • (2) The registered user’s registration information has been found untrue.
      • (3) The destination address of the goods cannot be confirmed
      • (4) The recipient of the goods has refused to accept of the goods.
      • (5) The registered user has used or attempted to use the Service for purposes or by means that may cause loss or damage to Quantium, other registered users, Japan Post, and third parties.
      • (6) The registered user in violation of the terms and conditions of Japan Post or for other reasons has become unable to receive services or cooperation from Japan Post.
      • (7) The registered user has interfered with the operation of the Service regardless of means.
      • (8) The registered user has suspended payments or become insolvent or a petition has been made against the registered user to commence bankruptcy proceedings, civil rehabilitation proceedings, corporate reorganization proceedings, special liquidation, or similar procedures.
      • (9) The registered user has received a disposition of dishonor because a check drawn or a bill or check endorsed by the registered user has been dishonored or a suspending transaction with clearing houses or received a similar disposition.
      • (10) A petition was made against him for foreclosure, provisional seizure, temporary injunction, enforcement, or auction.
      • (11) Proceedings have been made against the registered user for the recovery of taxes in arrears.
      • (12) The registered user has died or received a ruling of the commencement of guardianship, curatorship, or assistance.
      • (13) The registered user has not used the Service for 12 months or more, and has not responded to Quantium.
      • (14) The registered user falls under any of the items in Paragraph 5, Article 3.
      • (15) Quantium has determined the inappropriateness of the registered user’s continuous registration.
    • 2. If the registered user falls under any of the conditions specified in the preceding paragraph, the registered under shall lose the benefit of time as a matter of course for all the registered user’s debts that the registered user owes to Quantium, and the registered user shall pay all the debts to Quantium immediately.
    • 3. Quantium shall not be responsible for any loss or damage caused to the registered user as a result of measures taken in accordance with this article.
    • 4. A registered user may notify Quantium 30 days in advance in a manner that Quantium specifies to cancel the registered user’s registration.
    • 5. If a registered user’s registration is canceled in accordance with this article, the registered user shall follow Quantium’s instructions and return, discard, or dispose of software, manuals, and other items provided by Quantium.

    Article 17 Disclaimer of Warranty and Exemption from Responsibility

    • 1. Quantium shall not provide any guarantee for the contents of goods, the condition of goods sent, and any other condition of goods. Furthermore, Quantium shall not provide any guarantee for information on other registered users beyond what is specified in the Terms of Service even if a registered user directly or indirectly receives such information on other registered users from Quantium.
    • 2. The Service uses the international postal service of Japan Post. Quantium, however, shall not guarantee the use of the same, and shall not take any responsibility for cases where the international postal service of Japan Post is unavailable.
    • 3. A registered user shall comply with the terms and conditions of Japan Post at the registered user’s own responsibility and expense, and Quantium shall not be held responsible for any dispute, if occurred, between the registered user and Japan Post.
    • 4. Quantium shall not take any responsibility to compensate loss or damage suffered by registered users in connection with the transportation of the goods, including the non-arrival of the goods, any delay in delivery, and damage to the goods.
    • 5. A registered user shall investigate whether the use of the Service constitutes the violation of laws and regulations applicable to the registered user or the internal rules and regulations of industry associations at the registered user’s own responsibility and expense. Quantium shall not guarantee that the registered user’s use of the Service conforms to laws and regulations applicable to the registered user or the internal rules and regulations of industry associations.
    • 6. A registered user shall be responsible to arrange or settle any transactions, communications, or disputes between the registered user and other registered users, Japan Post, or third parties in connection with the Service or Quantium’s website, for which Quantium shall not take any responsibility.
    • 7. Quantium shall not take any responsibility to compensate loss or damage suffered by registered users in connection with Quantium’s suspension, stoppage, termination, failure, or change of the Service, deletion or loss of registered users’ messages, cancellation of the registration of registered users, loss of data in the use of the Service, machinery failures, loss, or damage, and other loss or damage caused to registered users in relation to the use of the Service.
    • 8. If Quantium’s website links to other websites or vice versa, Quantium shall not take any responsibility under any reason for such website or information obtained from such websites linked to or from Quantium’s website.

    Article 18 Dispute Settlement and Damage Compensation

    • 1. A registered user in violation of the Terms of Service or in relation to the user of the Service shall compensate for loss or damage to Quantium if the loss or damage is caused to Quantium by the registered user.
    • 2. If a registered user receives claims from other registered users, Japan Post, or third parties or there are disputes between the registered user and them, the registered user shall notify Quantium of the contents of the claims or disputes immediately. Furthermore, the registered user shall settle the claims or disputes at the registered user’s own responsibility and expense, and shall report the developments and results of the claims or disputes to Quantium.
    • 3. In connection with a registered user’s use of the Service, If Quantium receives claims under any reason from other registered users, Japan Post, or third parties, for infringement on their rights, the registered user shall compensate for the amount of money that Quantium is forced to pay to them.
    • 4. Quantium shall not take any responsibility for loss or damage caused to registered users in connection with the Service. Notwithstanding this paragraph and others that exempt Quantium from liability as stipulated in the Terms of Service, if Quantium is held responsible for loss or damage caused to registered users in accordance with the Consumer Contract Act or under any other reason, Quantium’s compensation shall not exceed the amount equivalent to the usage charges of the part of the Service where the loss or damage is originated from.

    Article 19 Validity Period

    • A registered user’s User Agreement with Quantium shall come into effect on the day the registration applicant’s registration is completed in accordance with Article 3, and remain in force until the day the registered user’s registration is cancelled or the provision of the Service is completed, whichever is earlier.

    Article 20 Change in Terms of Service

    • 1. Quantium may freely change the contents of the Service.
    • 2. Quantium may change the Terms of Service (including the rules and provisions of the Service to be posted on Quantium’s website, which applies to the rest of the paragraph). If Quantium changes the Terms of Service, Quantium shall inform each registered user of the contents of the change. If a registered user uses the Service after the registered user is informed of the contents of the change or the registered user does not cancel the Service within a period specified by Quantium, the registered user is deemed to have agreed to the change in the Terms of Service.

    Article 21 Contact/Notification

    • Registered users shall contact or notify Quantium if they have inquiries about the Service and Quantium shall contact or notify registered users about changes in the Terms of Service in a manner specified by Quantium.

    Article 22 Transfer of the Terms of Service

    • 1. A registered user shall not deliver or transfer the registered user’s position in the User Agreement or rights or obligations based on the Terms of Service to third parties or make security settings on or dispose of the said position or the rights or obligations for third parties without the prior written consent of Quantium.
    • 2. Quantium may transfer its business relating to the Service to another company, along with Quantum’s position in the User Contract, its rights and obligations based on the Terms of Service, registration information on registered users, and other customer information. Registered users shall be deemed to agree to such business transfer in accordance with this paragraph. The transfer of the business specified in this paragraph shall refer not only to usual business transfer but also to corporate divestiture and all other business transfer cases.

    Article 23 Entire Agreement

    • The Terms of Service shall constitute the entire agreement between each registered user and Quantium, and shall take precedence over all items in the Terms of Service preliminary agreed, asserted, or understood orally or in writing between each registered user and Quantium.

    Article 24 Separability

    • If any articles of the Terms of Service are all or partly determined invalid or unenforceable in accordance with the Consumer Contract Act and other laws, the remaining provisions of the Terms of Service shall remain in full force continuously, and Quantium and registered users shall make efforts to modify the said invalid or unenforceable articles and portions to a necessary extent and make the modified articles and potions enforceable with effects equivalent to the original articles and portions to meet the purpose of the Terms of Service legally and from an economic aspect.

    Article 25 Expiry of Terms

    • The provisions of Paragraph 2 of Article 5, Article 6 (only if charges remain unpaid), Paragraph 3 of Article 9, Paragraph 2 of Article 10, Paragraph 7 of Article 11, Paragraph 3 of Article 12, Article 13 to Article 15, Paragraph 2, Paragraph 3, and Paragraph 5 of Article 16, Article 17, Article 18, and Article 22 to Article 26 shall remain in full force after termination of the Terms of Service.

    Article 26 Governing Laws and Court of Competent Jurisdiction

    • The laws of Japan shall govern the Terms of Service, and Tokyo District Court shall have the exclusive jurisdiction of the first instance over all disputes arising in connection with the Terms of Service.

    Article 27 Amicable Settlement

    • A registered user shall agree that any question arising out of, or in connection with, the Terms of Service or any matter not stipulated herein shall be settled upon consultation based on the principle of good faith and mutual trust between Quantium and the registered user.

  • Privacy Policy

  • Quantium Solutions (Japan) Inc. (hereinafter “Quantium”) is an enterprise engaged in the logistics business. Quantium handles information used for the recruitment and adoption of employees as well as information on recipient addresses used for mailing service. In these activities, Quantium handles personal information as well, and has a social responsibility to protect and manage such personal information properly. Accordingly, Quantium has established a management system for personal information. The officers and employees of Quantium are committed to the execution and maintenance of the management system based on Quantium’s privacy policy, thus making every effort to handle personal information properly.
  • 1.Quantium clarifies the purposes of acquiring personal information, and acquires, uses, and provides personal information to the extent of achieving Quantium’s business objectives. Quantium does not make use of personal information aside from the purposes. For this reason, Quantium takes measures to prevent the use of personal information beyond the extent necessary for its original purpose.
  • 2.Quantium complies with laws, regulations, and rules that apply to the handling of personal information held by Quantium.
  • 3.Quantium makes appropriate safety measures to protect personal information from leakage, loss, and damage, and endeavors to take preventive and corrective actions whenever necessary.
  • 4.Quantium establishes a personal information consultation desk and constructs an internal system in order to respond promptly to consultation requests and complains about the handling of personal information subject to disclosure.
  • 5.Quantium makes continuous improvements in its management system and mechanism of protecting personal information.
  • 6.Acquisition and purposes of using of personal information
  • Quantium uses customers’ entrusted personal information only for the following purposes, and never uses customers’ entrusted personal information aside from the purposes. Customers are not obliged to provide their personal information. If they cannot provide their personal information, however, the customer will not be able to receive corresponding services or information.
    • (1) Provision of outsourcing services (e.g., invoicing, packing, and shipping)
    • (2) Guidance on service introductions
    • (3) Performance of agreements concluded by customers and Quantium
    • (4) Business communication with customers
    • (5) Response to inquiries, requests for information materials, and other requests
    • (6) Requests for questionnaire surveys, such as customer satisfaction surveys
    • (7) Negotiations and meetings with customers
  • 7.Provision of personal information to third parties and outsourcing
    • Quantium may disclose or provide customers’ entrusted personal information under the law. Otherwise, Quantium does not disclose customers’ entrusted personal information to third parties without the customers’ consent.
  • 8.Management of personal information
    • Quantium strictly manages customers’ entrusted personal information in accordance with its management system for personal information established in compliance with Personal Information Protection Management System - Requirements (JIS Q 15001).
  • 9.Disclosure, correction, and deletion of personal information
    • A customer can request a notification of the purposes of disclosing and using the customer’s entrusted personal information. If the customer finds that any contents of his/her personal information entrusted are untrue, the customer can request amendments or additions to or the deletion of the contents. If a customer requests the disclosure, correction, or deletion of personal information, the customer must contact the following contact office. Quantium will confirm the identity of the customer before disclosing, correcting, or deleting the customer’s personal information.
